Trademark enforcement in the UAE

Registration gives you the right; enforcement is how you use it. The UAE offers four routes, which can be combined. All of them require a registered UAE trademark (or a well-known mark) – a pending application supports a complaint but rarely a remedy.

1. Administrative complaints (fastest, cheapest)

Where: the Ministry of Economy & Tourism (MoET) IP department and the emirate-level Department of Economic Development – Dubai Economy & Tourism's commercial compliance section, ADDED in Abu Dhabi, SEDD in Sharjah.

What they do: inspect shops, warehouses and online sellers; seize infringing goods; fine the trader; order the removal of signage or products; refer serious cases to prosecution.

Time and cost: complaints are filed online with the registration certificate, evidence (photos, test purchase, listings) and a power of attorney; inspections usually happen within weeks. Fees are modest; the main cost is evidence collection.

Best for: counterfeit goods in the market, copycat shop names and signage, online marketplaces with a UAE presence.

2. Customs recordal and border seizures

Record the registration with the Federal Customs Authority and local customs (Dubai Customs has its own IPR unit). Recorded marks are flagged: suspect shipments are detained and the owner is notified to confirm within a short window, after which goods are seized and destroyed at the importer's cost. This stops counterfeits before they reach the market and is inexpensive to maintain.

3. Criminal prosecution

Counterfeiting, using a registered mark without authorisation, and knowingly selling counterfeit goods are offences under Decree-Law 36/2021 punishable by imprisonment and fines, with confiscation and destruction of goods and, for repeat offenders, closure of the business. A criminal complaint is filed with the police or public prosecution, usually after an administrative seizure has produced evidence.

4. Civil action

A claim before the civil courts (Dubai Courts, Abu Dhabi Courts, or the federal courts) for an injunction, damages, destruction of goods and publication of the judgment. Courts appoint an IP expert to report on similarity and damages – our team serves on the Dubai Courts' panel of trademark expert witnesses. Civil actions take 12–24 months through appeal and cost court fees plus counsel; precautionary seizure orders can be obtained quickly at the start.

Cease-and-desist letters

A letter from a registered agent or law firm resolves a large share of cases without proceedings. Send it after evidence is secured, not before, so the infringer cannot destroy stock.
