Trademark Registration for Startups in the UAE

Startups lose brands in two ways: someone files the name first, or the founder registers it personally and the company cannot show ownership at due diligence. Both are avoidable at the cost of a single filing.

When to file

Before the public launch, and before pitching with the name on the deck. The UAE is first-to-file; the application date is your priority date. Filing takes one day once the search is done.

What to file first

  1. The brand name as a word mark in the class of your core product or service.
  2. Class 35 or 42 as applicable (retail/marketplace or SaaS).
  3. The logo, later, once the design is stable.

Budget AED 6,500 per class in official fees plus agent fees; SMEs in the national programme pay half. Cost →

In whose name

File in the licensed operating company's name – the entity investors will buy into. If the company is not yet incorporated, the founder can file personally and assign to the company after incorporation (assignment), or wait a few weeks and file in the company's name. Free-zone (DIFC, ADGM, DMCC, in5, Hub71) licences are accepted.

Investor due diligence

Term sheets and SPAs routinely warrant that the company owns its brand. Have ready: the MoET certificate or application receipt, a copyright assignment from the logo designer, and recorded assignments if the mark moved from a founder.

International timing

The Madrid Protocol lets you extend the UAE application to 130+ countries within its first six months while keeping the UAE priority date. If Saudi Arabia or other non-Madrid markets matter, file there directly within the same six months. International →
