Trademark attorney vs agent in the UAE

Three kinds of professionals offer trademark help in the UAE, and the titles are used loosely. What matters is what each is legally allowed to do.

The three roles

Registered trademark agent Advocate / attorney Consultant / platform
Registered with MoET's trademark-agent register Yes Not necessarily No
Can file and prosecute applications for others Yes Only if also a registered agent No – must use an agent
Can file oppositions, grievances, recordals Yes Yes (via agent registration or as counsel) No
Can appear in UAE courts No (unless also a licensed advocate) Yes, if licensed in that emirate No
Can act as court-appointed expert If on the court's expert panel Rarely No
Typical fee model Fixed per class / per action Hourly or per case Package with margin

In the UAE the term "trademark attorney" has no formal status. Filing rights come from the trademark-agent register maintained by the Ministry of Economy & Tourism; agents must meet qualification requirements and renew their registration. Court advocacy rights come from being a licensed advocate with the relevant emirate's legal-affairs department.

What you need for each task

Task Who
Search, filing, office actions, publication, registration Registered agent
Renewals, assignments, licences, changes Registered agent
Oppositions and grievances before MoET Registered agent (a lawyer may assist on evidence)
Administrative complaints to DED / MoET, customs recordal Registered agent
Civil litigation or criminal prosecution Licensed advocate, usually working with a registered agent on the technical side
Expert report on similarity or damages for a court Court-appointed IP expert

Fees

Registered agents quote fixed fees per class for filing and per action for oppositions and recordals; ours cover everything from search to certificate. Advocates charge hourly or per instance of litigation. Consultants and foreign online platforms resell an agent's work with a margin and rarely handle office actions themselves. Official MoET fees are identical whoever files – AED 6,500 per class. Fee schedule →

Questions to ask before instructing anyone

  1. Are you, or a named person in your firm, on the MoET trademark-agent register? (Ask for the registration.)
  2. Who will actually log in and file – you or an associate?
  3. Is your search opinion written, and does it cover Arabic-script marks?
  4. What is the total fee for one class through to certificate, including publication and registration?
  5. How are office actions, oppositions and translations charged?
  6. If it goes to court, whom do you work with?
