10 Trademark Registration Mistakes in the UAE (and How to Avoid Them)

From files we have inherited from applicants and other firms, these are the errors that most often cost money, months or the mark itself.

  1. Choosing a descriptive name. "Dubai Fresh Juice" describes the goods and is refused. Add a distinctive element before you print anything.
  2. Searching in English only. Most conflicts are with Arabic-script marks. Search transliterations. Trademark check →
  3. Filing in the wrong class. A retailer filing only Class 25 (goods) when the business is a shop (Class 35), or a SaaS company filing Class 9 only. Classes →
  4. Applicant name not matching the licence. "LLC" missing, an old company name, or the founder instead of the company – all produce office actions or unenforceable registrations.
  5. Relying on the trade name. The licence name gives no brand rights. Trade name vs trademark →
  6. Missing the 30-day payment windows. Publication (AED 750) and final registration (AED 5,000) are each due within 30 days; penalties run at AED 100 and AED 1,000 per month and the file can be abandoned.
  7. Filing the logo only. A redesign leaves you unprotected; register the name as a word mark.
  8. Foreign owner filing with an unlegalised POA. Weeks of delay and a missed priority date. POA →
  9. Never watching the Bulletin. Conflicting marks register unopposed and must be cancelled the hard way. Monitoring →
  10. Forgetting renewal. Year 10 comes without a reminder from MoET. Renewal →

Bonus: using ® before registration, using a designer's logo without a copyright assignment, and appointing a distributor before registering in the UAE and GCC.
